Court fees and costs in connection with legal proceedings in Labour Court
Unlike civil court proceedings, you do not have to pay court costs when filing a law suit at court. If you are able to come to an agreement with the opposing party during the conciliation hearing, no further costs are incurred except the costs for service of process (Euro 6.00).
If no mutual agreement is reached, there will be a court hearing. This results in a court fee which is to be paid by the party that loses the trial or, if no judgement is made, by the plaintiff.
In legal proceedings before the Labour Court of first instance, which is the district court, you must pay the costs for your lawyer no matter whether you win or lose the trial (unlike legal proceedings at the Labour Court of high instance, which is the regional court, and the second level of jurisdiction.)
You may also be eligible for legal aid in Labour Court proceedings. That means the state will pay for the costs of the legal proceedings.
